Terms of Use

Overview & Acceptance

These Terms of Use govern your access to and use HostServy.com services, including Dedicated Servers, Virtual Private Servers (VPS), and RDP hosting. By subscribing to, accessing, or using our services, you agree to be bound by these Terms and our Privacy Policy. We reserve the right to update these Terms at any time by posting the revised version; your continued use of the services will constitute acceptance of those changes.

1. Definitions

For the purposes of these Terms: “HostServy.com”, “we”, “us”, “Provider”, and “Company” refer to HostServy. “You”, “your”, “Client”, “Customer”, and “Member” refer to any person or entity that purchases or uses our services.

2. Prohibited Activities

Unless explicitly permitted in writing by HostServy, the following activities are strictly prohibited due to their illegal, harmful, or resource-intensive nature:

IRC bots
Cryptocurrency mining tools
Proxy servers or proxy websites
DDoS, DoS, or brute-force tools
Email spam tools (e.g., AMS, TurboMailer)
Hosting game servers
Hacking, cracking, or carding operations
Mail bombers, sniffers, IP spoofing
Port scanners or Telnet/SSH automation
All versions of Ultimate Bulletin Board (UBB)
Fake login or phishing pages
Media streaming services
Resource-heavy software using over 25% CPU
Any other malicious or harmful activity

3. Spam Policy

You may not use HostServy services for spam, unsolicited emails, or unwanted requests. Violation may result in immediate account termination without notice or refund. We reserve the right to request proof of recipient opt-in.

4. Resource Usage Policy

Bandwidth

While our plans include unmetered bandwidth, excessive use that impacts network performance may lead us to adjust your allocation.

Memory (RAM & CPU)

We monitor resource usage. Ideal usage should remain under 1%. Excessive consumption affecting performance may result in temporary or permanent suspension.

5. Content Storage & Backups

All content stored on HostServy servers is the customer’s responsibility. HostServy does not guarantee data backups or recovery. Regular backups are strongly recommended.

6. Account Setup

Remote Desktop (RDP) or VPS accounts are typically activated within 1–24 hours following payment. We’ll notify you proactively if delays exceed 24 hours.

7. Account Security

You are responsible for securing your account with strong, unique passwords. Accounts linked to illegal or suspicious activity may be suspended immediately. Please report any suspected credential breaches promptly.

8. Indemnification

You agree to indemnify, defend, and hold HostServy.com, its affiliates, officers, employees, and agents harmless from any claims, liabilities, damages, costs, or legal fees resulting from:

Your use of our services
Your breach of these Terms
Third-party claims related to content hosted by you
Unlawful actions (e.g., infringement, defamation, spam)
Damage to HostServy or other users arising from your conduct

9. IP Addresses

Any IP address assigned to you remains the property of HostServy.com. You have no ownership rights and we reserve the right to change or revoke IP assignments at our discretion.
